When parents can decide on child custody in private, they can choose who the children will live with — which is considered custody — and who will have visitation rights, which means scheduled nights, weekends, vacations, and other important timesharing privileges.

If the parents cannot decide on child custody and visitation details, the court will require both to attend mediation to work through the terms of the agreement. This must occur before the judge will agree to hear the case during litigation.

If you can decide on the terms of the divorce privately or during mediation – and do not plan to litigate the details inside the courtroom – for property division, child custody, and all applicable financial matters during the waiting period.
